IMHO, this is the fundamental problem with our existing copyright system.  
IIRC, the video tape fair use battle went all the way to the Supreme Court in 
the 70s.  So it will be again for new technologies because groups like the 
MPAA and RIAA have so much money and power to influence saps like the FCC.
