IANAL, but I read an interesting rationale on:

They speculated that Boise knew they were going to lose the motion and
chose not to attend.  As such, in the media, Boise can deny having been
beaten since he wasn't there and can't comment as he would still need
to 'research' the ruling.

Just a thought.
