I think if one stays in the unlicensed band then they can't complain
too much about someone else in the unlicensed band interfering with
them.

The MASSPORT incident is an interesting study in what happens when
some overzealous people decide that the 802.11 frequencies are theirs
for "public safety" reasons.  You could google for massport fcc and 
continental.  Basically they got spanked by the FCC.
